WHAT DOES EMPLOYEE FIDUCIARY, LLC ("EMPLOYEE FIDUCIARY") DO WITH YOUR PERSONAL INFORMATION?
Companies choose how they share your personal information. Federal law gives consumers the right to limit some but not all sharing. Federal law also requires us to tell you how we collect, share, and protect your personal information. Please read this notice carefully to understand what we do.
The types of personal information we collect and share depend on the product or service you have with us. This information can include:

  • Account Balances and Account Numbers
  • Account Transactions and Investment Holdings
When you are no longer our client, we continue to share your information only as described in this notice and as permitted by applicable law. Some of this information may be considered sensitive under state law.
All financial companies need to share customers' personal information to run their everyday business. In the section below, we list the reasons financial companies can share their customers' personal information; the reasons Employee Fiduciary chooses to share; and whether you can limit this sharing.

What we do
How does Employee Fiduciary protect my personal information? To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include computer safeguards, encrypted data transmission, secured files, and physical access controls. We do not sell personal information.
How does Employee Fiduciary collect my personal information? We collect your personal information, for example, when you:
  • Open an account
  • Provide account information or seek advice about your investments
  • Seek financial or tax advice, or tell us about your investment or retirement portfolio
We also collect your personal information from others, such as the plan sponsor, the plan's financial adviser, our affiliate or other companies you authorize to share information with us.
Why can't I limit all sharing? Federal law gives you the right to limit only:
  • Sharing for affiliates' everyday business purposes—information about your creditworthiness
  • Affiliates from using your information to market to you
  • Sharing for non-affiliates to market to you
State laws and individual companies may give you additional rights to limit sharing. See the State-Specific Disclosures section below.
Definitions
Affiliates Companies related by common ownership or control. They can be financial and nonfinancial companies.
  • Our affiliate is Frugal Financial Retirement Plan Services, LLC (a financial company)
Non-affiliates Companies not related by common ownership or control.
  • Employee Fiduciary does not share with non-affiliates so they can market to you.
Joint marketing A formal agreement between non-affiliated financial companies that together market financial products or services to you.
  • Employee Fiduciary does not jointly market.
State-Specific Disclosures

Depending on your state of residence, you may have additional rights under applicable state privacy law. The following disclosures apply to residents of specific states.

California Residents

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides California residents with specific rights regarding their personal information. These rights include:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you.
  • Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions.
  • Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt-Out of Sale or Sharing: Employee Fiduciary does not sell or share personal information for cross-context behavioral advertising purposes.
  • Right to Limit Use of Sensitive Personal Information: You may direct us to limit our use and disclosure of sensitive personal information to what is necessary to perform our services.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

Nevada Residents

Nevada law (NRS 603A) provides Nevada residents with the right to opt out of the sale of certain covered information. Employee Fiduciary does not sell covered information as defined under Nevada law.

Nevada residents may also request to be placed on our internal do-not-call list at any time by contacting our office by phone at 877-401-5100 or by email at privacy@employeefiduciary.com. Vermont Residents

In response to Vermont regulations, we will not share information about Vermont residents with non-affiliated third parties for marketing purposes, except as permitted by Vermont law and as described in this notice.

Colorado, Connecticut, Texas & Virginia Residents

Depending on your state of residence and applicable law, you may have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your personal information, subject to legal retention requirements
  • Opt out of certain types of sharing, where permitted by law
  • Appeal a denied request

These rights may be limited in some situations allowed by law.

We may need to verify your identity before responding. You may also use an authorized agent where permitted. We will respond to verified requests within the timeframe required by applicable law.

Retention of Personal Information

We retain personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and applicable legal requirements.

SMS / Text Messaging Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Mobile phone numbers collected by Employee Fiduciary are used solely for informational and transactional SMS messages, which may include two-factor authentication (2FA) verification codes, service updates, billing notifications, and account alerts. Your mobile number and SMS consent information are shared only with our SMS service provider for the sole purpose of enabling message delivery.

You may opt out of SMS messages at any time by replying STOP, CANCEL, QUIT, UNSUBSCRIBE, or END to any message received from Employee Fiduciary. For questions about your SMS data or to exercise privacy rights, contact privacy@employeefiduciary.com.

Changes to This Privacy Notice

We may update this Privacy Notice from time to time to reflect changes in our practices or applicable law. We will deliver an updated notice to you as required by law. The effective date at the top of this document reflects the most recent revision.
